Rules of the Instagram prize game

These Rules (hereinafter referred to as the Rules) describe the Instagram promotional game (hereinafter referred to as the Game) organized by Kluschowsky-Schmuck (owner: Agile Academy Kft, headquarters: 3527, Miskolc, Soltész Nagy Kálmán 23 2/2.) and the conditions of participation.

The present Rules of the Game, which also include the Privacy Policy, will be published on the Instagram page https://www.instagram.com/kluschowsky.germany/ for the duration of the Game.
The Player (see below) accepts the provisions of these Rules and Regulations by commenting on the Game area and acknowledges that he/she is bound by the provisions of these Rules and Regulations

1. The Player automatically participates in the Game on the basis of the criteria and conditions detailed in the description of the Game by commenting on the Game Platform, and thereby fully accepts the terms and conditions of these Rules, including the data management provisions. If the Player does not agree with the terms and conditions set out in these Rules or does not comply with the terms and conditions set out in these Rules, the Player shall not be eligible to participate in the Game and the Promoter shall be entitled to exclude such Player from the Game at its sole discretion.

The Promoter declares that the present Game advertised by it is not subject to the provisions of Act XXXXIV of 1991 on the organisation of games of chance.

2. By participating in the Game, the Player acknowledges that he/she has read the Rules in full and accepts them unconditionally. By participating in the Game, the Player expressly acknowledges his/her prior knowledge and acceptance of the provisions on data management.

3. Duration of the Game

4. Description of the Game:
The Player does not need to register to participate in the Game. The essence of the Game is that the Player will be drawn 1 lucky winner in a prize draw published on the Organiser’s Instagram page. The prize is a pair of earrings. (Pearl Breeze Flower Studs – Kluschowsky Jewelry)

5. Application for the Game, conditions of participation
Only those Players who fulfil the conditions of participation set out in these Rules and Regulations in full and together shall be eligible to participate in the Prize Draw.

The conditions for participation in the Game are:

– the Player must have a registered Instagram account during the Game

– The Entrant must have a registered Instagram account and must have a registered Instagram account and consent to the processing of his/her personal data,

– Likes the post about the competition,

– follow the instagram page,

– two instagram followers tagged in a comment

By commenting, the Player automatically accepts the rules of the game.

– Consent to the processing of the Player’s personal data as set out herein and the continued existence of such consent to the processing of personal data as and until the date set out in these Rules,

An application for the Game is not valid if the conditions of participation are not met, the Promoter will not be able to accept it and the Player will not be eligible to participate in the draw.

Entry to the Game is open for the entire duration of the Game and the date of entry will not affect the Player’s chances of winning.

6. The winner of the draw will be the Player who is eligible to win a prize in accordance with these Rules and Regulations.

The prize is non-transferable and cannot be redeemed for cash.

The Promoter will not draw any other prizes in the Game in addition to the prizes listed herein.

7. One Player will be drawn in the draw. If the winner is not eligible to win the prize or does not provide any feedback on the prize within 3 working days of the notification being sent out, a new winner will be drawn.

8. Notification of the Winner(s)
The Winner will be notified via the contact details provided when applying for the Prize Draw (in which case the commenter will receive a message on their Instagram profile) within 2 working days of the draw via private message and in a comment during the prize draw.

The exact name, email address, phone number, address will be provided in a private message to identify the Winner and to deliver the prizes.

9. Delivery of the prize
The prize will be delivered by DHL courier service, the cost of which will be borne by the organiser, without any obligation to pay the winner. Delivery is only possible within Germany.

10. Processing
The processing of Players’ personal data is governed by the provisions of this section. These Rules shall also be deemed to be the Individual Privacy Policy.

Participation in the Game and the provision of data during the Game is voluntary and duly informed.

The legal basis for the processing of personal data is the voluntary consent of the Players to the processing of their data – which is given at the time of participation in the Game and acceptance of these Rules and, in the case of the drawn Player(s), is based on Act CL of 2017 on the Rules of Taxation, Act C of 2000 on Accounting and Act CXVII of 1995 on Personal Income Tax.

By participating in the Game, the Player gives his/her voluntary and explicit consent to the Organiser to process his/her data for the following purposes and on the following legal basis:

10. Responsibility
The Organiser is not responsible for any omissions (names, addresses, short replies, etc.), delays in notification or delivery of the entries. All consequences arising from incorrectly provided data or from the inability to receive mail in their mailbox are the responsibility of the Players. The correctness of the data is not normally verifiable by the Promoter during (or after) the application process for the Game. In any event, the responsibility for this and all legal and financial consequences thereof shall rest solely with the Players.

By participating in the Game, the Player acknowledges that the content, performance, message and data transmission and response speeds of the technical infrastructure of the Game are dependent on the server technology and may be adversely affected by factors beyond the control of the Promoter, such as (but not limited to) connection failure, server computer performance, network congestion, network congestion, coverage and the maintenance of a secure network connection. The Organiser excludes all liability arising from this paragraph.

The Promoter excludes its liability for quality defects and malfunctions of the prizes, unless the exclusion of liability is expressly prohibited by Hungarian law. The winner may assert claims for defects and malfunctions of the prize under the prize warranty and guarantee.

The Promoter excludes all liability for any claims for compensation or indemnification for any costs, damages, losses arising from or related to any defects, deficiencies, malfunctions, delays or losses arising from participation in the Games, or any errors, defects, malfunctions, delays or losses arising from or related to the Games. The Player, by participating in the Game, expressly waives any and all claims against the Promoter or any third party in connection with the conduct of the Game, the draw, the prizes, the winners.

The Promoter accepts no responsibility for the accuracy, reliability, fault-free operation, completeness or fitness for purpose of the Game. Furthermore, the Promoter shall not be liable if the Game or the website containing the Game and these Rules are temporarily unavailable for technical reasons during the duration of the Game. The Promoter shall also not be liable for any errors and their consequences arising from any cause beyond its control (such as technical malfunction or failure of the Internet network).

11. Other
The Promoter reserves the right to change these Rules.

The Rules will be available in electronic form at Rules of the Instagram prize game – Kluschowsky Jewelry for the duration of the Game.
